How it started · editorial summary

The court checked documents on expenses and payment allocation and the basis for electronic service, then awarded debt and statutory late-payment interest.

The dispute and the court’s decision

The court awarded the apartment association Narva linn, Võidu prospekt 7 principal and statutory late-payment interest against owner XX. The claim was supported not only by invoices but also by meeting decisions, management plans and supplier documents. After the payment order application, the owner emailed an objection. The court accepted it despite the lack of a digital signature because it had no doubt about the sender. The case was transferred for further consideration. The association clarified its demand, seeking maintenance payments for periods before and after 2018. At that stage, the interested person did not respond. The court separately explained service. It used an email address previously confirmed by the participant and already used to communicate with the court. Attempts at other delivery methods were unsuccessful. On that basis, the court deemed the documents served. On the merits, the court noted that invoices alone do not prove the amount owed. The association must show the basis for shared expenses and their allocation among owners. Here it supplied calculations, minutes approving rates and plans, floor-area data, contracts and service invoices. The court found the principal proved. As charges covered periods before and after 2018, the court applied the relevant legislation for both periods. Use of the ruling in a new dispute requires attention to later legislative changes and the circumstances of that case. The ruling of 13 September 2022 awarded principal and statutory interest on it until performance. Costs were imposed on the interested person, for separate quantification. The award does not establish today’s unpaid balance.

Outcome of this decision

Grant the association’s application: award principal and statutory late-payment interest on it until performance against XX. XX bears costs, to be quantified separately after finality.

4. XX shall bear the litigation costs. The court will quantify them within a reasonable time after the decision becomes final.

How it started · editorial summary

The court rejected the objection that payments were unrecorded and awarded remaining debt. Charges were checked against decisions, invoices and bank data.

The dispute and the court’s decision

The court awarded the apartment association Narva linn, Kangelaste prospekt 42 a debt balance against owner XX. It checked bank data and the association’s calculation and found the owner’s proven payments accounted for. The association sought maintenance charges and interest. During proceedings it updated the amount for new charges and funds received. The owner claimed regular payment and challenged invoices, meeting minute extracts and interest calculations. The owner also demanded supplier contracts and considered charges unproven without them. The court examined articles, rate approval decisions, supplier invoices and payment data. Common electricity and waste collection were included in the maintenance rate set by the meeting, not charged separately. It found no excessive heating charges. The validity of meeting decisions was not at issue in this case. Comparing the owner’s statements with the association’s calculation, the court found matching payments and dates. The owner supplied no proof of payment of the remaining disputed invoices. The court derived entitlement to statutory interest from the law and articles, rejecting the argument that a separate meeting decision was required for this recovery. The ruling of 29 July 2022 awarded principal, accrued interest and further statutory interest on principal until payment. It also awarded 606 euros in procedural costs against the owner. This is the outcome established then; subsequent performance is not confirmed.

Outcome of this decision

Grant the association’s application. Award principal, accrued interest and further statutory interest on principal until performance against interested person XX. Allocate costs to that person and award 606 euros.

How it started · editorial summary

The court found bailiff funds already accounted for and awarded a 761,18 euro balance against the company. The claim concerns its earlier ownership period.

The dispute and the court’s decision

The court awarded the apartment association Narva linn, Raudsilla tn 10 a debt of 761,18 euros against Osaühing Peremaakler. It rejected the company’s objection that bailiff funds were ignored: the 645 euros received had already been deducted. The association sought maintenance charges for the company’s period of apartment ownership, accrued interest and costs. The company argued there was no debt because the association received money from the bailiff after auction sale. Its representative did not attend the hearing, and the applicant requested determination on the merits. The court established the ownership period and related association membership. It examined articles, management plans, meeting decisions, supplier contracts, invoices and debt calculations. The company did not specifically challenge cost allocation or prove other payments in the disputed period. The court found the calculation substantiated because it accounted for the 645 euro transfer. Sale of the apartment did not remove liability for remaining charges from the company’s ownership period. The ruling of 20 July 2022 awarded 761,18 euros in principal, 120,01 euros in interest to 16 March 2022 and further statutory interest from 17 March until principal was paid. The court reduced costs to 478* euros, limiting recoverable payment order stage costs and reducing the hearing attendance amount claimed. Statutory interest on costs runs after entry into force. The document does not confirm subsequent payment of these amounts.

Outcome of this decision

Grant the association’s application. Award 761,18 euros in debt, 120,01 euros in interest and statutory interest on 761,18 euros from 17.03.2022 until performance against Osaühing Peremaakler. Award 478* euros in costs and statutory interest on that sum after entry into force.

How it started · editorial summary

The association sought debt and late-payment interest. The court found only part of the service charges proved, excluded unsupported charges and credited earlier payments towards accrued late-payment interest.

The dispute and the court’s decision

Narva linn, Spordi tn 4 korteriühistu sought utility and management debts from XX. Following an objection in payment-order proceedings, the claim was transferred to Viru Maakohus. The court requested supplier records, the basis for tariffs and an explanation of the allocation between co-owners, but no additional evidence or explanation was provided. The court found that invoices to an owner alone did not prove the association’s costs or their correct allocation. Service charges were supported by resolutions and the earlier tariff; a later increase lacked documentary support. Several utility and earmarked charges were not supported by the necessary records and were not awarded. The court applied XX’s earlier payments first to accrued late-payment interest because their intended allocation could not be established. It therefore refused the claim for late-payment interest already due, treating it as paid. Alongside proved principal, it awarded continuing statutory late-payment interest from 13 November 2020 until the awarded principal is paid. Each participant was left to bear their own costs because the partial refusal resulted from the association’s failure to provide evidence.

Outcome of this decision

The application was granted in part: proved service charges and continuing statutory late-payment interest from 13 November 2020 until the awarded principal is paid were awarded. Accrued late-payment interest was treated as covered by earlier payments; unsupported charges were not awarded. Each participant bears their own costs.

How it started · editorial summary

The association proved principal but not grounds to apply the articles’ maximum interest. The court awarded debt and statutory interest.

The dispute and the court’s decision

The court awarded the apartment association Narva linn, Tallinna mnt 32 principal against owner XX but reduced the interest claim. The articles stated a maximum rate, but the association supplied no separate meeting decision establishing its application. The association sought payment for maintenance and utilities and charged interest of 0,07% per day. During proceedings it increased the claim for subsequent months and provided additional documents at the court’s request. The owner received the materials personally but submitted no position or objections. The court checked ownership, invoices, minutes approving rates, supplier documents and calculations. It found principal proved. The absence of objections did not replace that examination. It assessed interest differently. The articles required interest at the amount and in the manner set by the meeting, capped at “no more than 0,07% per day”. The court explained that a ceiling does not itself establish a rate of 0,07%. Without the necessary decision, it applied the statutory rate and calculated accrued interest on that basis instead of the sums sought. The ruling of 29 April 2022 partly granted the application, awarding principal, interest accrued at the statutory rate and further statutory interest on principal until performance. The interested person was left to bear their own costs and 90% of the association’s costs, with the remaining 10% borne by the association. The amount was to be determined separately. The act resolves a specific charging dispute and does not confirm that the award has already been paid.

Outcome of this decision

Partly grant the application. Award principal, accrued statutory interest and further statutory interest on principal until performance against interested person XX. Leave their own costs to them; allocate 90% of the association’s costs to them and 10% to the association. Determine the monetary amount separately.

How it started · editorial summary

The owner, a commercial company, appealed against recovery, citing non-receipt of invoices and case documents.

The dispute and the court’s decision

Tartu Ringkonnakohus upheld the award against OÜ Peremaakler in favour of Narva linn, A. Bastrakovi tn 3 korteriühistu: 1003,78 euros in building maintenance costs and 44,69 euros in late-payment interest. The company’s appeal was dismissed and appeal costs allocated to it. The county court was to determine court costs later. The company claimed it had received neither association invoices nor court documents and could not inspect the application or object. The circuit court checked the judicial information system. It showed that materials were sent to the company and one statutory representative confirmed receipt. Documents were also sent to another representative at an address known to the court from other proceedings, with a service procedure warning. The court found the company had an opportunity to present its position. The court also examined the grounds for charges. The association supplied invoices, accounting data, articles, decisions approving management plans, and heating and gas equipment maintenance supplier invoices. The court considered these to prove the costs and allocation between owners, with charges consistent with the adopted procedure. The company gave no specific objections to the debt calculation in its appeal. The award was therefore upheld after checks of both service and debt evidence. The ruling does not confirm actual payment of the sums awarded.

Outcome of this decision

Dismiss the appeal and uphold the ruling of 22 September 2021. Allocate appeal costs to OÜ Peremaakler, with the amount set later by the county court.

How it started · editorial summary

The association sought charges jointly and severally from two owners. Only the proved repair-fund contributions were awarded. The appeal court later increased that part to include December 2020; the remaining dismissal for lack of proof was retained.

The dispute and the court’s decision

Narva linn, A. Puškini tn 13 korteriühistu sought debt jointly and severally from two owners, XX. They challenged the amount charged, the floor area used and receipt of invoices. One owner also relied on the condition of a partition wall and alleged failures by the association. The court repeatedly asked the association to explain its calculation and supply supplier records. The first-instance court rejected the contention that invoices had not been received and did not treat the condition of the premises as an independent basis for avoiding every charge in this dispute. However, recovery still required proof of costs and their allocation. The association’s own invoices and accounting table did not fully establish these matters. Supplier-liability records and the basis of many tariffs were not provided. The first-instance court found only the repair-fund contributions proved and awarded them jointly and severally. The remaining claims were rejected for lack of proof. On 4 February 2022, Tartu Ringkonnakohus increased the repair-fund award to include December 2020, so that part covers the whole of 2020. The remaining dismissal was retained. Each participant bears their own costs in both instances.

Outcome of this decision

The joint and several award was limited to proved repair-fund contributions. On 4 February 2022, Tartu Ringkonnakohus increased it to include December 2020 and retained dismissal of the other claims for lack of proof. Each participant bears their own costs in both instances.

How it started · editorial summary

The association appealed a declaration that the company owed no stairwell and heating debt. The appellate court reversed for inadequate examination of the basis and calculation and remitted the case.

The dispute and the court’s decision

Osaühing Brainella sought a declaration that it owed Narva linn, A. Puškini tn 12 korteriühistu nothing for use and heating of a separated part of a stairwell. Its claim was clarified to 1354.51 euros. It disputed a 15.98 euros monthly charge and additional floor area used for heating. The first-instance court granted the claim and the association appealed. Tartu Ringkonnakohus found the claim’s scope, the charges’ legal basis and their amount inadequately examined. Absence of a proved lease did not yet exclude a possible charge under owners’ resolutions on common-property use. Those resolutions should not simply have been disregarded. The amended claim’s limits and burden of proof also required clarification. The court rejected the association’s limitation objection to the declaration claim itself. Its position might have a different significance for its monetary claim, but neither debt nor its absence was finally established. The 16.01.2018 judgment was reversed and the case remitted to the same court, with costs to follow the rehearing’s result. Success on appeal was not an award or cancellation of the disputed sum.

Outcome of this decision

The association’s appeal was granted. Viru Maakohus’s judgment of 16.01.2018 was reversed and the case remitted. The basis and amount of charges require further examination; no final debt was established. The first-instance court will decide costs according to the further outcome.

How it started · editorial summary

Osaühing Brainella challenged charges for using and heating part of a stairwell. The first-instance court declared only that no lease existed; the appellate court later granted all claims, reversing the refusals and the costs allocation.

The dispute and the court’s decision

Osaühing Brainella sought declarations against Narva linn, A. Puškini tn 12 korteriühistu that no lease existed and no payment was owed for part of a stairwell. It also sought heating calculations based only on 88.4 m² and a declaration that 285.63 euros was not owed for 28.02.2011–31.01.2016. Invoices included a monthly charge of 15.98 euros. The case was being reheard after reversal and remittal of an earlier judgment. The court found no evidence of a lease and granted that declaration. However, additional charges could arise from owners’ resolutions governing use of common property rather than a contract. Calling a charge rent did not change its legal basis. The company did not deny exclusive use of part of the stairwell. The relevant resolutions had not been invalidated, and the court found no grounds of nullity. It therefore refused a declaration of no payment duty. It also rejected the requested heating-area declaration and the related claim that 285.63 euros was not owed. This judgment did not itself award that sum for enforcement. The association must bear 25% of the company’s costs and the company 75% of the association’s costs, with amounts determined separately. Later, on 26 February 2021, Tartu Ringkonnakohus reversed the refusal of the remaining claims and the costs allocation, granting the claim in full. It held that the earlier tariffs applied only in the relevant financial years and that no basis for the additional charge after 2010 had been proved. It declared that the disputed charge was not payable, heating for 28.02.2011–31.01.2016 was payable on an area of 88.4 m², and the heating debt of 285.63 euros did not exist as at 31.01.2016. The association bears costs at both levels, with amounts to be fixed separately.

Outcome of this decision

Initially, the court declared that no lease existed and rejected the remaining claims; it did not award 285.63 euros, and costs were allocated 25%/75%. On 26 February 2021, Tartu Ringkonnakohus reversed the refusals and the costs allocation: it declared that the disputed charge was not payable, heating for 28.02.2011–31.01.2016 was payable on an area of 88.4 m², and the heating debt of 285.63 euros did not exist as at 31.01.2016. How it started · editorial summary

The dispute concerned the basis for extra charges for the shared staircase and the floor area used to charge heating for non-residential premises.

The dispute and the court’s decision

The circuit court granted Osaühing Brainella’s claim in full, declaring no obligation to pay the disputed rent and no additional heating debt. Osaühing Brainella sought a declaration that it did not have to pay rent or the disputed extra heating charge to the apartment association at A. Puškini tn 12. The company owned non-residential premises. The association charged for use of a separated stair section and calculated heating over a larger area. The company objected that no lease existed and heating should be charged for its premises’ area of 88,4 m². The association argued that the extra charges were based on general meeting decisions and use of the separated staircase expressed consent to the charge. On rehearing, Viru Maakohus confirmed there was no contract but found a payment duty based on meeting decisions. The company appealed dismissal of the rest of its demands. Tartu Ringkonnakohus agreed that an owners’ majority can in principle decide ordinary management of shared property. However, these particular decisions had been adopted with the 2004, 2005 and 2010 management plans and applied within those respective years. The association did not establish a basis for the disputed charges in later years. The circuit court granted the claim in full. It declared no lease relationship or rent obligation and that heating from 28 February 2011 to 31 January 2016 was payable on an area of 88,4 m². The company did not owe 285,63 euros in heating debt as at 31 January 2016. All litigation costs at both levels were imposed on the association, to be quantified by the county court after finality. No demand to demolish the partition was decided in this case.

Outcome of this decision

Grant Brainella’s claim in full: no lease relationship or rent payment duty exists; heating for the stated period is calculated on 88,4 m²; no debt of 285,63 euros is owed. The association bears costs at both levels, to be quantified separately.

How it started · editorial summary

After clarifying the extent of withdrawal, the association confirmed payment of the entire debt and requested an end to the case.

The dispute and the court’s decision

The court terminated the apartment association Tallinna mnt 42’s case after confirmation of full payment and left costs to the association. Narva linn, Tallinna mnt 42 korteriühistu sought debt and late-payment interest from XX. The case began in expedited payment order proceedings, but the payment proposal could not be served within a reasonable time and the claim was transferred to Viru Maakohus. The association clarified the amount and charging period there. The association later withdrew the application, citing payment. The court noted that the first withdrawal concerned an earlier, smaller amount and did not explain the increased part. After a court query, on 28 February 2020 the association confirmed full payment and withdrawal of the entire application. The other participant made no objections. The court accepted the withdrawal and terminated proceedings without an award of the original debt. The ruling does not award debt again: termination was based on performance confirmed by the applicant. The association did not seek its costs from XX. The court left them to the applicant and found no costs reimbursable to the other participant. It decided to address the association’s request for refund of part of the fee in a separate ruling after entry into force. Neither the refund itself nor its amount is yet ordered in this ruling.

Outcome of this decision

Terminate proceedings. Leave costs to the association; there are no costs reimbursable to the other participant. Decide the fee refund in a separate act.

How it started · editorial summary

The association sought debt and late-payment interest. XX challenged the calculation, payment allocation and tariff resolutions. The court found the calculation proved and granted the claim.

The dispute and the court’s decision

Narva linn, Kangelaste prospekt 42 korteriühistu, formerly KÜ KANGELASTE 42, sought management and utility debt with late-payment interest from XX. XX accepted a general duty to contribute but disputed the amount, citing missing emailed invoices, unclear tariffs, defects in repeat meetings and incorrect crediting of payments. The court compared invoices, the consolidated calculation and payment records. The association agreed to apply payments to principal for the months specified by XX, and the court found this reflected in the final calculation. Objections to tariff resolutions did not establish nullity or timely challenge; the court treated the resolutions as valid. Accrued late-payment interest was checked separately for periods before and after the 2018 legislative change and found substantiated. The claim was granted: principal, accrued late-payment interest and continuing late-payment interest on unpaid principal from 1 January 2019 at the ECB rate determined for each half-year plus 8 percent annually were awarded until principal is paid. Costs were imposed on XX, with their amount to be determined separately. Actual payment of the award was not established.

Outcome of this decision

The claim was granted: the association was awarded principal, accrued late-payment interest and continuing late-payment interest on unpaid principal from 1 January 2019 at the ECB rate determined for each half-year plus 8 percent annually until principal is paid. XX bears their own and the association’s costs, the latter to be fixed separately.

Kangelaste 42: appeal refused admission in a simplified case

How it started · editorial summary

The circuit court examined special appeal admission conditions in a case involving a small claim.

The dispute and the court’s decision

The circuit court refused to admit XX’s appeal in the apartment association Kangelaste 42’s simplified case, finding no grounds for admission. Korteriühistu Kangelaste 42 had obtained an award of management cost debt and accrued late-payment interest against defendant XX in the county court. Further statutory late-payment interest on principal was also awarded and costs allocated to the defendant. XX appealed, alleging breaches of legal rules, and requested state legal aid. Tartu Ringkonnakohus was deciding whether to admit the appeal. The case concerned a small monetary claim under the simplified procedure, subject to special appeal conditions. The court checked for an obvious misapplication of law, material procedural breaches or clearly incorrect assessment of evidence capable of affecting the outcome. The circuit court found none. It considered that the county court had examined charges, facts and evidence in detail and applied the relevant rules. The defendant’s disagreement with the outcome alone did not suffice for admission. The court refused to admit the appeal and deemed it returned to the applicant. This is an appeal admission ruling, not a new award of the same sums. The legal aid application was left undecided. The unpaid appeal fee was not required because the appeal was not admitted. A separate possibility to challenge the refusal itself is provided.

Outcome of this decision

Refuse to admit XX’s appeal and deem it returned. Leave the state legal aid application undecided; no fee is payable for the appeal that was not admitted.

Kreenholmi 38: costs allocated to association after claimant waived the claim

Ruling · Viru Maakohus · First instance

KÜ Kreenholmi 38 · 80152617

Participants and roles: Claimant — XX; Defendant — KÜ Kreenholmi 38

How it started · editorial summary

The parties disputed when the claimant’s demand was satisfied; that determined who should bear costs.

The dispute and the court’s decision

The court accepted XX’s waiver of the claim against KÜ Kreenholmi 38 and terminated the case seeking a declaration of no debt. Costs were allocated to the association: it must pay the claimant 37,50 euros, and a further 37,50 euros in fees was ordered refunded from the budget after entry into force. The claimant applied on 3 April 2018 to challenge the charged debt. On 3 May, the claimant waived the claim because the demand had been satisfied and requested costs against the association. The association agreed to termination but insisted the dispute had been resolved before the claim was filed, so each should bear its own costs. The court disagreed. A March invoice attached to the claim still showed the disputed debt. It concluded that the association satisfied the demand immediately after the claim arrived. It also noted that the charging dispute had remained unresolved for more than a year since December 2016 while interest accrued. Seeking judicial protection was considered justified. The claimant paid a 75 euro fee. Due to waiver, the court ordered half refunded from the budget and awarded the other half against the association. There were no other proven costs. The ruling ended the case through waiver rather than a separate determination of the amount or absence of debt. Actual receipt of the awarded and refunded money is not confirmed.

Outcome of this decision

Accept waiver and terminate proceedings. The association bears costs: award the claimant 37,50 euros against it, with a further 37,50 euros in fees refunded from the budget after entry into force.

Tallinna mnt 42: heating charges, rates and clarification of claims

Judgment · Tartu Ringkonnakohus · Appeal

How it started · editorial summary

A majority resolution does not replace all owners’ agreement on a different allocation of expenses.

The dispute and the court’s decision

KÜ Tallinna mnt 42 (now — Narva linn, Tallinna mnt 42 korteriühistu). Owner XX disputed maintenance and heating charges with KÜ Tallinna mnt 42. The association relied on meeting resolutions imposing an additional charge for each individual room with altered heating equal to 50% of the apartment’s total heating cost and setting the area used for charging. The owner sought recalculation or a declaration that no debt existed. The first-instance court dismissed the claim, relying in part on unchallenged meeting resolutions. The appellate court reversed and remitted. After repeated amendments, it remained unclear which claims the first-instance court had decided. The court should have discussed the available legal protection and explained that compulsory recalculation as formulated had no independent substantive basis; a declaration of no debt was possible. Allocating common expenses otherwise than in proportion to ownership shares requires all owners’ consent. A meeting resolution without unanimity does not replace that agreement; failure to challenge it in time did not resolve this issue. Evidence and the existence of debt must be examined on rehearing. The appeal was allowed in part, with costs to be allocated by the first-instance court according to the final outcome.

Outcome of this decision

The judgment was reversed and the case remitted to clarify the claims and examine the debt; no specific recalculation was ordered.

Tallinna mnt 42: mutual maintenance and heating dispute ended by a 5 000-euro agreement

How it started · editorial summary

The association and XX ended two opposing claims by agreement. Settlement of their mutual demands was made conditional on payment.

The dispute and the court’s decision

The court approved the agreement between Narva linn, Tallinna mnt 42 korteriühistu and XX to end two opposing claims concerning maintenance and heating. XX undertook to pay the association the agreed amount within three months after the agreement enters into force. The case involved the association’s debt claim and XX’s claim against it concerning charges. The ruling gives no detailed calculations or objections. After payment, the parties regard mutual demands for the agreed period as resolved: both unpaid invoices and possible recalculations in XX’s favour. The court checked the agreement’s permissibility and enforceability and terminated proceedings. It did not separately establish the correctness of every previous charge. The hearing was cancelled and each party bears its own costs; partial court fee refunds will be decided by separate rulings. This ruling establishes neither performance of the agreement nor refund of the fees.

Outcome of this decision

Approve the agreement for XX to pay the association the agreed amount within three months after the agreement enters into force. After payment, mutual demands for the agreed period are settled. Terminate proceedings and cancel the hearing; each bears its own costs. Court fee refunds are decided separately.
