How it started · editorial summary

The association waived its demand against two individuals XX, describing it as unfounded. One participant agreed; the other did not participate.

The dispute and the court’s decision

The apartment association Narva linn, Juuli tn 3 made a damages demand against two interested persons XX. It then waived the application, stating that it considered its own demand unfounded. One participant XX agreed to termination and confirmed having no costs. The other had not been served and did not participate; consent is not inferred from silence. The court examined the association’s right to dispose of the demand and whether waiver was permissible. It found no conflict with law or public interest, accepted the waiver and ended proceedings by its ruling of 14 September 2026. The statement that the demand was unfounded expresses the association’s assessment, rather than an independent judicial finding of no damage or liability. Costs were left with the applicant association, with none reimbursable. The operative part establishes neither a damage amount nor any duty of the individuals to pay. The ruling ends a specific proceeding after voluntary waiver; it is not an award or confirmation that damage was compensated.

Outcome of this decision

Accept the Juuli tn 3 association’s waiver of its damages application and terminate proceedings. Leave costs with the association, with none reimbursable; send the ruling to the participants.

How it started · editorial summary

Claimant XX disputed an obligation to ERGO; the association was the second defendant. The settlement redirects the insurance demand to the association and sets costs.

The dispute and the court’s decision

Claimant XX sought a declaration against ERGO Insurance SE and the apartment association Narva linn, Juuli tn 7 that no duty existed to pay the insurer’s recourse demand, a claim for monetary reimbursement. Both legal persons were defendants. The account of the initial claim contains no separate monetary demand by the association against the claimant. At the hearing, the participants settled. ERGO waives recourse against claimant XX and directs a demand concerning the same insured event to the association. The association admits liability within the agreement. The insurer performs the agreed set-off under the association’s insurance contract without applying the 300-euro excess, the association’s contractual share of damage cover. The ruling gives no specific principal insurance compensation amount. Claimant XX waives the claim against both defendants. Under the agreement, the claimant and insurer must each separately reimburse the association 110,40 euros in costs. Participants retain their other costs. These are two separate costs payments to the association, rather than damages paid to the claimant. The court found the terms permissible and enforceable, approved the settlement on 31 August 2026 and terminated proceedings. Half the court fee, 210 euros out of 420 euros paid, is refunded to claimant XX, rather than the association. By agreement, the period to appeal the ruling was reduced to three working days. The association’s admission of liability is agreed by the settlement participants; it is not a judicial finding of proved fault on every circumstance of the insured event. Performance of the mutual accounting arrangements is not confirmed.

Outcome of this decision

Approve the settlement: ERGO waives recourse against claimant XX, directs the demand to the association and performs an insurance set-off without the 300-euro excess; the association admits liability. The claimant waives the claim. The claimant and ERGO each reimburse the association 110,40 euros; other costs remain with the participants. Terminate proceedings; refund claimant XX 210 euros, half the fee.

Participants and roles: applicant — Narva linn, Madise tn 6 korteriühistu; person concerned — owner XX

How it started · editorial summary

The owner’s silence did not replace review of invoice grounds, payments and late-payment interest.

The dispute and the court’s decision

Narva linn, Madise tn 6 korteriühistu claimed management charges and late-payment interest from owner XX. The owner received the documents but did not respond. In non-contentious proceedings, the court independently examined the basis and amount: issuing invoices alone is insufficient. It established meeting resolutions setting rates, a valid management plan and supplier costs. Heating was allocated by floor area, water and gas by readings and supplier prices. A late increase for a new period was left unexamined because it followed the deadline and would require a fresh opportunity to respond. A separate application for the new period remains possible. The court checked allocation of two payments: without selection of a particular obligation, the statutory sequence applied, first costs and late-payment interest, then principal. Late-payment interest was checked using the exact statutory annual rate rather than the association’s rounded daily rates. Principal recovery was limited to the amount claimed although the calculated balance was higher. The original late-payment interest claim was partly refused; the remaining accrued late-payment interest and further statutory late-payment interest on unpaid principal from 22 August 2026 until payment were awarded. Costs were reduced from the 800 euros sought to 560 euros: a 50-euro fee and 510 euros for legal assistance. The late increase and some representative time were not reimbursed. The order does not establish performance of the award.

Outcome of this decision

The application was allowed in part; debt and late-payment interest were awarded and costs reduced. The late increase for a new period was left unexamined.

How it started · editorial summary

Two applicants XX sought reversal of the association’s decisions of 31.05.2020; after proceedings resumed, the participants agreed a settlement.

The dispute and the court’s decision

Two applicants XX challenged Narva linn, P. Kerese tn 19 korteriühistu decisions adopted without a meeting on 31 May 2020. The court received the application in July 2020. Proceedings were stayed in September 2022 pending another case and resumed in March 2026. After resumption, the court suggested an agreement. The parties initially submitted differing versions. The applicants proposed payment of 1000 euros within ten calendar days after finality. The association proposed two payments with specific deadlines. The court said it could not approve inconsistent terms. The applicants then accepted the association’s latest version. On 29 July 2026, the court approved a settlement: both applicants fully give up their challenge to the decisions, and the association reimburses them a total of 1000 euros in litigation and legal assistance costs. Payments of 500 euros are due no later than 5 August and 5 September 2026. The condition that no additional demands remain from this case is linked to full payment of that sum. The court found the agreement permissible and enforceable and terminated proceedings. It did not determine the lawfulness of the association decisions on their merits. Each participant bears expenses not mentioned in the agreement. An appeal was allowed within 15 days of service of the ruling.

Outcome of this decision

Approve the settlement: waiver of the challenge to the decisions in exchange for reimbursement by the association of 1000 euros in two 500-euro payments by 05.08.2026 and 05.09.2026. Terminate proceedings; other costs remain with the participants.

How it started · editorial summary

After payment of the demand, the insurer waived its application; the dispute remained over who should bear litigation costs.

The dispute and the court’s decision

AB “Lietuvos draudimas“, through its Estonian branch, brought a claim for damages and late-payment interest against Narva linn, Rahu tn 28a korteriühistu. The court accepted the application on 14 July 2026. After receiving payment on 17 July, the insurer waived the application and asked for costs against the association. The association did not object to termination but disputed costs. It relied on the short delay, voluntary performance and possibility of resolution without court action. It explained that its own insurer had transferred compensation on 25 June, but onward payment to the applicant was delayed by work organisation. The association reported paying 999,15 euros of principal and 1,42 euros of late-payment interest on 17 July. The court accepted the waiver and terminated proceedings. It left costs with the association: the demand was met after filing although the association knew of it beforehand and missed the payment deadline. Internal organisational reasons were not grounds to relieve it of costs. The principal demand was not awarded again. Of the 575 euros requested, the court awarded 470 euros: a 50-euro fee and 420 euros for legal assistance. All 3,5 hours of work were necessary, but the reimbursable hourly rate was reduced from 150 to 120 euros. Statutory late-payment interest accrues on unpaid costs from finality until performance. The court merely explained the option to request refund of half the fee; it did not order a refund in this ruling.

Outcome of this decision

Accept the waiver and terminate proceedings. Award the insurer 470 euros in costs against the association, plus statutory late-payment interest from finality until payment.

How it started · editorial summary

Under its terms, breach of the schedule permits the association to treat the agreement as invalid.

The dispute and the court’s decision

Narva linn, V. Gerassimovi tn 16 korteriühistu and debtor XX submitted a written settlement after service of a payment proposal in expedited payment-order proceedings. The case was transferred from Pärnu Maakohus to Viru Maakohus for approval. The court examined permissibility and enforceability, approved the settlement before non-contentious proceedings began and discontinued the case. The debtor acknowledged management and utility arrears payable over twelve months. The agreement does not release the debtor from current monthly payments. On improper performance, including full or partial non-payment of at least one scheduled instalment, the association may unilaterally treat the agreement as invalid. The order approves that condition but does not establish its actual use or performance of the schedule. Each party bears its own costs without reimbursement.

Outcome of this decision

A twelve-month settlement schedule was approved and the case discontinued. Current payments remain due.

The settlement distinguishes scheduled debt from the statement about current charges.

The dispute and the court’s decision

Narva linn, Soldina tn 18c korteriühistu sought payment from two debtors XX in expedited payment-order proceedings. The proposed schedule contained additional conditions, so the case was transferred to Viru Maakohus. After clarification, the participants submitted a new settlement, which the court approved before non-contentious proceedings began and discontinued the case. The acknowledged obligation includes principal, late-payment interest and costs, with six monthly payments. Initial dates precede the order, but performance was not established. A delay exceeding ten calendar days permits the association to seek enforcement of the judicial settlement. The statement about current charges expressly creates no independently enforceable obligation under this settlement. After the final payment, the debt is treated as paid. Additional costs remain with the participants.

Outcome of this decision

Six payments were approved; delay exceeding ten days permits an enforcement application. The case was discontinued.

How it started · editorial summary

The court established leakage from a common system and the claim transferred to the insurer.

The dispute and the court’s decision

AB “Lietuvos draudimas“, through its Estonian branch, sought reimbursement from Narva linn, Tallinna mnt 32 korteriühistu of 1964 euros paid for water damage and late-payment interest. The association submitted no position, but the court examined evidence of insurance, payment, causation and the amount of damage. The water came from a defective common system: piping and a towel dryer installed by the association. Location inside an individual apartment does not exclude common ownership. The court found a breach of the maintenance duty and a causal link to the damage; no evidence excusing the breach was provided. Insurance payment transferred the owner’s claim to the insurer. The estimate established restoration costs; the mentioned equipment costs were outside the claim. The award was 1964 euros in damages and 117.42 euros in late-payment interest for 23 October 2025 to 25 May 2026, totalling 2081.42 euros. From 26 May 2026 statutory late-payment interest runs on principal until payment. A further 575 euros in costs was awarded with statutory late-payment interest from finality of the order quantifying costs until performance. Payment by the association was not established.

Outcome of this decision

The association was ordered to pay 2081.42 euros in damages and accrued late-payment interest, further late-payment interest on principal, and 575 euros in costs with separate late-payment interest.

The dispute and the court’s decision

Applicant XX challenged resolutions of the general meeting of Narva linn, Rakvere tn 87 korteriühistu, including removal and election of the board. The applicant sought a declaration of nullity or invalidation and interim protection. Interim protection had previously been refused. Before the hearing, the applicant withdrew the main application. The court accepted withdrawal and discontinued the case without deciding the legality of the meeting resolutions on the merits. A new application between the same participants on the same grounds and subject matter is precluded. Costs were placed on the applicant, but the association received 225 euros rather than the 600.10 euros claimed. The representative’s hourly rate was reasonable; necessary time was reduced from four hours to one and a half: the case was simple, the representative took no procedural steps and the hearing was cancelled in good time. Half the main application fee, 25 euros, is refunded; the fee for the already decided interim application is not. Other costs remain with the participants.

Outcome of this decision

The case was discontinued on withdrawal without a merits finding on the resolutions. The association was awarded 225 euros in costs.

How it started · editorial summary

Payment after filing did not eliminate costs, but the court reduced their amount.

The dispute and the court’s decision

Narva linn, Madise tn 6 korteriühistu claimed management-charge arrears from owner XX. During proceedings, the association confirmed payment of the principal claim and withdrew its application. The owner disputed the need for proceedings and the costs claimed. The court accepted the withdrawal and discontinued proceedings. Costs were placed on the owner because the debt existed when the application was filed and was paid later, making the proceedings objectively justified. The principal debt was not awarded again. Of the 350 euros claimed in costs, the court awarded 100 euros: a 50-euro state fee and 50 euros for necessary work by the contractual representative. It refused 250 euros for preparing the original application because a board member represented the association then and the contractual representative joined later. Statutory interest runs on the awarded costs from finality of the order until payment; performance was not established.

Outcome of this decision

Following payment of principal, proceedings were discontinued; only 100 euros in costs and statutory interest on them were awarded.

How it started · editorial summary

The association sought disposal of the apartment but waived its claim after sale and repayment of the debt.

The dispute and the court’s decision

Narva linn, Uusküla tn 17 korteriühistu brought a claim requiring owner XX to dispose of the apartment. It relied on maintenance arrears and failure to implement the owners’ decision on disposal. During the case, the association reported that the defendant had already sold the apartment and paid the debt in full. It later clarified that it was waiving the claim and requested refund of half the court fee. On 6 March 2026, the court accepted the waiver and ended proceedings without a decision on the merits. The ruling imposed no duty to sell: the stated reason to continue the dispute had by then ceased. The court explained the consequences of waiver, including inability to repeat the same dispute between the same parties on the same grounds. The court ordered a refund to the association of 212,50 euros, half the 425-euro fee paid. Each party retained its other costs. The court noted that, after explanation of the possibility of claiming costs, the association no longer requested them in its final document and treated this as an intention not to recover them from the defendant.

Outcome of this decision

Accept the waiver and terminate proceedings. Refund the association 212,50 euros in court fees; each party bears its own costs.
