The dispute and the court’s decision
By Viru Maakohus’s judgment of 30 November 2012, OÜ IKB was ordered to pay 728.75 euros, including debt and interest, to KÜ Narva Lootus, now Narva linn, Energia tn 2a korteriühistu. The company appealed.
The circuit court examined only admission in a simplified case. The first-instance court had not given separate permission to appeal; ordinary appeal instructions did not constitute it. No obvious substantive or procedural error or clearly incorrect evaluation of evidence materially affecting the result was identified. The company’s different assessment alone was insufficient.
Admission was refused and the appeal returned. This order was neither a new award nor a full determination of the debt on the merits. It does not explain the specific types of charges.
Outcome of this decision
OÜ IKB’s appeal was refused admission and returned. Appeal admissibility was decided without a new award or a full appellate review of the debt and interest.
