The dispute and the court’s decision

KÜ Puškini tn 12, now Narva linn, A. Puškini tn 12 korteriühistu, claimed premises-related charges and interest from XX. Following a limitation defence, it reduced its calculation to principal of 651.09 euros and interest of 250.22 euros. XX disputed floor areas and charging bases, including heating, waste removal, use of a stairwell and advertising charges, and relied on payments already made. The court distinguished the duty to contribute from proof of a particular sum. The association had to establish total expenses and their allocation. It failed to do so for some purchased services. However, the court treated unchallenged meeting decisions on advertising, stairwell use and waste charges as binding; XX had not proved obstruction of access to the waste container. Even that proven portion was already covered by XX’s payments for the relevant period. On 31 May 2012 the court therefore dismissed the claim in full, including principal and interest, with costs against the association. This was not an award returning an overpayment to XX. Confirmed later costs proceedings: on 14 June 2013 the circuit court retained reimbursement of 200 euros to XX for appellate representation but refused additional first-instance expenses, where assistance had been provided as advice. That order did not reconsider the underlying debt. Entry into force and actual performance have not been separately reverified.

Outcome of this decision

Debt and interest were dismissed in full: some charges were unproven and payments covered the proven portion. Costs were allocated to the association; the later costs order did not reconsider the main dispute.
