The dispute and the court’s decision

XX sought documents from KÜ Suur Viis Narva, now Narva linn, Suur tn 5 korteriühistu. The association initially disputed the claim. At a preliminary hearing it agreed to prepare the available materials and supplied them on 17 July 2012, stating that some requested documents had never existed. XX accepted that the claim had been fully satisfied. The court did not enter a judgment on admission: performance had already occurred and a fresh order to supply documents was unnecessary. It considered that the parties had effectively agreed on the subject matter and performed that agreement before the ruling. The proceedings were ended by the order of 19 July 2012. Costs were allocated to the association because it had satisfied the claim after proceedings began and its conduct had caused the litigation. XX was awarded a 319.55-euro state fee. Confirmed subsequent development: on 27 March 2013 the circuit court reversed a later additional-costs order and left the separate application unexamined. The amount of costs should have been challenged in the original order; termination and the earlier state-fee award were not reversed. The later source reports reimbursement of that fee, but actual payments have not been independently verified.

Outcome of this decision

Proceedings ended after supply of the documents; the association bears costs and XX was awarded a 319.55-euro state fee. A later additional-costs dispute did not change the main outcome.
