The dispute and the court’s decision

The claimant XX sought a declaration that the general meeting decisions of KÜ Kangelaste 3, now Narva linn, Kangelaste prospekt 3 korteriühistu, of 3 May 2012 were void. Voidness means lacking legal effect from the outset. The claimant appealed following Viru Maakohus’s judgment of 17 March 2014. This order does not explain the specific content of the meeting decisions. During the appeal the parties settled: the claimant withdrew the claim, the association did not object, and both sides confirmed that they had no mutual claims arising from this case. The court found the agreement lawful and capable of performance, without harm to an important public interest. It set aside the earlier judgment and terminated proceedings; it did not determine the validity of the meeting decisions anew on the merits. Each side bears its own costs. The court ordered the refund of 87.50 euros, half the appeal fee, but refused to refund half the fee paid for the first-instance claim. The parties shortened the deadline for appealing the order to two days from service. Entry into force has not been reverified.
