Partial appeal-fee relief in a challenge to meeting decisions

XX appealed the county court’s judgment of 16 May 2011 in the dispute with Korteriühistu Narva Sõbralik concerning its meeting decisions of 6 May 2010. The appeal had previously been left without further processing because the 319.55-euro court fee had not been paid. XX then requested procedural assistance. The circuit court assessed the information on income and necessary expenditure. It considered the full fee a substantial burden but found no basis for a complete exemption. Relief covered 269.55 euros; the remaining 50 euros was payable within 30 days after the order entered into force, with information enabling the court to verify payment. The appeal remained pending correction of that defect. Refusal to admit it was described as the consequence of failing to correct the defect in time, rather than a decision already made. Confirmed subsequent development: a separate judgment of 11 June 2012 partly allowed the appeal, invalidating three meeting decisions and leaving a fourth in place. That outcome belongs to the later merits judgment, not this fee order. Actual payment and enforcement have not been separately checked.
