The dispute and the court’s decision
XX challenged the Suur 8 owners’ decisions of 18 August and 8 September 2011 to separate from Korteriühistu VANA LOSS (now Narva linn, Suur tn 8 korteriühistu) and establish a new association. The applicant alleged defects in convening the meetings and requested a stay of the registration application pending resolution of the dispute. The county court granted interim protection on 14 September 2011.
Another interested owner, XX, appealed, arguing that the applicant had not proved inheritance of the apartment or the consent of the other co-heirs. The circuit court found these objections insufficient to overturn the measure. Acceptance of the inheritance could be established from undisputed circumstances without additional confirmation by an inheritance certificate; transfer through inheritance occurs outside the land register. The applicant acted in their own name as a co-owner to protect common property, so the objection concerning representation of other persons did not defeat standing.
The appeal was dismissed and the registration stay maintained until the main proceedings ended. Appeal costs were allocated to the appellant. This order did not finally determine the validity of the separation and formation decisions. Subsequent developments and actual implementation have not been reverified.
Outcome of this decision
The appeal was dismissed. The temporary stay of the new association’s registration application remained in place; the appellant bears appeal costs.
