The dispute and the court’s decision

The claimant XX challenged Korteriühistu XX’s general meeting decision of 3 May 2012 confirming earlier meeting decisions. At the claimant’s request, the county court stayed proceedings until other cases ended, treating their outcomes as necessary to resolve this dispute. The association appealed the stay. The circuit court found that sequence incorrect. Where a new confirmatory decision existed, its validity had to be resolved first. Only then could invalidation of the earlier confirmed decisions be addressed. The present case therefore did not depend on those other proceedings in a way justifying waiting for them. Viru Maakohus’s order of 1 October 2012 was set aside and the stay application refused. Refund of the appeal fee was also refused; each side bears its own circuit-court costs. This order did not determine the validity of the meeting decisions themselves. The source states that the order was not appealable.

Outcome of this decision

The stay was set aside and the application to stay proceedings refused. The fee was not refunded and each side bears its own appeal costs; the validity of the meeting decisions was not determined.
