The dispute and the court’s decision
XX sought explanations about loan repayments and paid workers, together with loan, repair and insurance documents, from KÜ Pähklimäe 7/11, now Narva linn, Pähklimäe tn 7 korteriühistu. The association maintained that it had already offered inspection where the documents were held; XX requested copies for detailed examination. Inspection was agreed during proceedings and copies were later supplied. XX withdrew the claim, considering the purpose of the action achieved.
On 12 July 2013 the county court accepted withdrawal and terminated proceedings. This did not order the association to provide the full document list in the future: the substantive claim was no longer determined. The court explained withdrawal’s consequences for bringing the same action again. In its initial costs ruling, it treated the claim as satisfied after filing and awarded XX 276 euros in legal costs and the state a 300-euro court fee against the association.
Confirmed subsequent development: on 4 September 2013 the circuit court maintained termination but varied costs.
