The dispute and the court’s decision
Narva linn sued Narva linn, Tallinna mnt 18 korteriühistu, called KÜ Nartall-18 in the order, for access to documents. The parties agreed that within three days after approval of the settlement the association would provide the city’s representative with documents from the general meeting of 20 January 2013: a copy of the minutes, the attendance list with signatures and powers of attorney, and the minutes containing the decision to restore the membership contribution. The 2012 annual report and 2013 economic activity plan were also to be provided.
The association undertook to reimburse the city’s litigation costs of 325* euros by 28 February 2014 and bear its own costs. The court approved the settlement, discontinued proceedings, cancelled the scheduled hearing and ordered repayment of half the court fee, 125* euros, to SA Narva Linnaelamu. The parties waived an appeal. The order records an obligation to provide documents rather than proof that it was performed.
