The dispute and the court’s decision
The claimant XX sued bailiff XX, buyer OÜ Wokolad and Korteriühistu XX to invalidate a forced auction and restore property rights. The first-instance court dismissed the claim. On appeal, the claimant challenged the necessity and conduct of the sale.
The circuit court found a material breach. The bailiff had already applied other recovery measures but had not established why they were not actually being implemented or collected the necessary information about repayment. Evidence indicated that the creditor could have been satisfied by means less burdensome to the debtor. Enforcement serves satisfaction of the claim, not a property sale for its own sake.
However, the court rejected the argument that auction notice had been defective: the notification requirements were met. Unexamined alternative recovery methods, rather than notice, justified invalidating the auction.
The earlier judgment was set aside in full. The new judgment invalidated the auction and recognised the claimant’s ownership. Claims to restore the ownership entry and remove the mortgage were remitted to the county court because clarification of the claims and participation of the person affected by the mortgage entry were necessary. First-instance costs will be allocated on final determination; the bailiff and OÜ Wokolad bear appeal costs jointly and severally. This does not mean register changes have already been completed.
Outcome of this decision
The auction was invalidated and XX’s ownership recognised. Claims to correct the ownership entry and remove the mortgage were remitted; the bailiff and OÜ Wokolad bear appeal costs jointly and severally, while first-instance costs remain for later determination.
