The dispute and the court’s decision

Narva linn, A. Puškini tn 22 korteriühistu sought 20,039.44 kroons in maintenance and utilities from commercial-premises owner OÜ Kotkas & Ko. The company disputed the general tariff, repair-loan costs, heat charges despite its own gas heating and separate waste charges, having contracted with Adelan Prügiveod OÜ. The court held that commercial-premises owners must contribute to association costs on the same basis as apartment owners. Meeting decisions and the association’s calculation supported most of the debt. The court was not persuaded that independent gas heating justified excluding the heat charges. However, the Adelan Prügiveod OÜ contract and witness evidence established that the company had not used the association’s container since 23 January 2008. The court excluded 3,100 kroons in separate waste charges, awarded 16,939.44 kroons and left each party with its own costs. On 6 June 2011 Tartu Ringkonnakohus subsequently also excluded unproved indirect-heating charges, reducing debt to EUR 819.54. It maintained refusal of separate waste charges while explaining that this did not remove liability for general site costs. County-court costs were split 64% to the company and 36% to the association, and appeal costs 76% and 24% respectively.

Outcome of this decision

The claim was partly allowed for 16,939.44 kroons, excluding 3,100 kroons in separate waste charges. Each party bore its own costs; the later appeal further reduced the debt to EUR 819.54.
