The dispute and the court’s decision

Korteriühistu Tallinna mnt 21 Narva, now Narva linn, Tallinna mnt 21 korteriühistu, sought a debt from XX. Before judgment, both sides confirmed that payment had satisfied the claim. The county court dismissed the claim and placed costs on the association. On appeal, the association argued that the court should either have granted an admitted claim or terminated proceedings with costs against the defendant. The circuit court distinguished those situations. The defendant had not admitted the claim but reported payment and the absence of any remaining claim; the association itself confirmed performance. There was no basis to award an already performed obligation again. To end proceedings after payment under the costs rule for withdrawal, the association could have submitted a withdrawal application. It merely cited that rule without withdrawing the claim. The court could not substitute its own decision for that expression of intention. The appeal was dismissed and the judgment of 1 November 2011 upheld. The association bears costs in both instances. This does not mean the debt was unpaid: performance itself removed the basis for a further award.

Outcome of this decision

The association’s appeal was dismissed and dismissal of the claim following confirmed payment was upheld. The association bears costs in both instances; it had submitted no withdrawal application.
