The dispute and the court’s decision

Two claimants XX sought a declaration that the general meeting decisions of KÜ Kangelaste 3, now Narva linn, Kangelaste prospekt 3 korteriühistu, of 12 October 2012 were void. Voidness means lacking legal effect from the outset. The claimants appealed after Viru Maakohus’s judgment of 9 December 2013. This order does not explain the substance of the disputed meeting decisions. During the appeal the parties settled: the claimants withdrew their claim with the association’s consent, and the participants confirmed that they had no mutual claims arising from this case. The court found the agreement lawful and capable of performance, without harm to an important public interest. It therefore set aside the earlier judgment and terminated proceedings. This order did not determine the lawfulness of the meeting decisions on the merits. Each participant bears their own litigation costs. The court ordered the refund of 125 euros, half the appeal fee, but refused to refund half the first-instance fee. The parties agreed on a two-day deadline from service for appealing the order. Further appeals and entry into force have not been reverified.
