Editorial summary

The dispute and the court’s decision
In OÜ Rosehill’s dispute with KÜ Kangelaste 3, now Narva linn, Kangelaste prospekt 3 korteriühistu, over the meeting decisions of 30 May 2011, the association invoked limitation. It treated the clarified 2013 pleading as the date the claim was brought. The company relied on its initial application of 5 August 2011 in earlier proceedings.
The court found that the initial application already challenged these decisions and was filed in time. The court’s prolonged failure to determine it and its later separation into distinct proceedings did not mean the company had abandoned the claim. Bringing the pleading into the required claim format in 2013, as directed by the court, remedied defects rather than initiating a new claim for the first time.
The interim judgment of 26 August 2013 rejected limitation and continued proceedings, leaving costs for the final judgment. Confirmed subsequent development: on 16 September 2013 the county court declared all meeting decisions void because of convening defects. The circuit court’s later order of 3 July 2014 concerned the amount of costs and maintained 818.57 euros for the company. These later outcomes should not be attributed to the interim judgment itself. Entry into force and actual payments have not been separately reverified.
Outcome of this decision
The association’s limitation defence was rejected and proceedings continued. Validity of the meeting decisions and costs remained for later determination.
