The dispute and the court’s decision
Korteriühistu Tallinna mnt 21 Narva, now Narva linn, Tallinna mnt 21 korteriühistu, claimed 162.96 euros in premises-related arrears from XX. XX raised limitation against earlier charges and reported payment. After filing, the association itself confirmed full satisfaction but sought costs against the defendant.
The supplemental judgment of 1 November 2011 supplied the facts and reasons for dismissal announced on 13 October. As payment was undisputed, there was no basis to award the same obligation again. The claim was dismissed and costs allocated to the association as the unsuccessful party. No new debt award or repayment of a credit balance was ordered.
Confirmed subsequent development: on 7 May 2012 the circuit court upheld dismissal and allocated both instances’ costs to the association. It distinguished payment from admission of the action: confirming performance did not request a judgment granting the claim. Nor had the association filed a withdrawal, which was needed for its proposed route of termination and costs allocation. Entry into force and actual payments have not been independently reverified.
Outcome of this decision
The 162.96-euro claim was dismissed after confirmed payment, with costs against the association. The appeal was later dismissed: payment was not admission and no withdrawal had been filed.
