Rahu 14: claim to annul auction refused admission after expiry of the time limit
Ruling · Viru Maakohus · First instance
Narva linn, Rahu tn 14 korteriühistu · 80015323
Entry into force has not been reverified
Participants and roles: Claimant — XX; Defendants — bailiffs XX, other organisations and the association
Editorial summary
The court considered admissibility of a late claim to annul an auction and related interim protection requests.
The dispute and the court’s decision
The court refused to admit a claim to annul an auction because the limitation period had expired. Claimant XX sought invalidation of a repeat apartment auction and amendment of the land register entry. Named defendants included bailiffs, other organisations and Narva linn, Rahu tn 14 korteriühistu. The claimant alleged improper notice of the auction and requested interim measures.
Viru Maakohus refused to admit the claim. The enforcement documents showed service of the auction record no later than 26 February 2018, whereas the claim in this case was filed on 29 October. The challenge period was 30 days. Some defendants invoked limitation. The court also considered that another court had refused to admit an earlier claim with the same requests; in its view, that application did not suspend the period.
The court considered the claim legally hopeless due to limitation and ordered return of the application and attachments. It also refused to admit the request to exempt the claimant from the fee because the case had no prospect of success.
The claimant’s objection to the court’s actions was rejected: requests for protective measures had repeatedly been left for defects to be remedied with instructions not followed. No interim measures were imposed. Costs were allocated to the claimant. This is a procedural refusal: the auction’s validity and correction of the entry were not determined on the merits.
Outcome of this decision
Refuse to admit the claim and procedural assistance application; return the claim. Reject the objection to the court’s actions and requests for interim measures. The claimant bears costs.
Participants and roles: Claimant — KÜ Narva linn, Kreenholmi tn 7; Defendant — owner XX
Editorial summary
The court determined the claim by default after no response to the served documents.
The dispute and the court’s decision
The court awarded the association debt and a 175 euro fee by default. KÜ Narva linn, Kreenholmi tn 7 brought an unpaid utilities claim against owner XX. It alleged that some payments had not arrived and sought principal and accrued late-payment interest.
The court sent the documents to the defendant, allowed 20 days after service for a written response and warned of a default judgment. The documents were served but no response arrived in time. The association had requested default determination if no response was submitted.
Viru Maakohus granted the claim by default judgment. Under that procedure, the claimant’s factual assertions are treated as admitted because of non-response; the court checks their legal sufficiency. Principal and accrued late-payment interest were awarded against XX.
The association also sought 240 euros in costs, but the court awarded only the 175 euro fee paid. It refused 65 euros in legal costs: the application was signed by the association’s statutory representative and, in the court’s view, no contractual representative participated. The judgment is immediately enforceable. The defendant was informed of the right to apply to set aside the default judgment (kaja) to reopen proceedings. The awards do not confirm actual recovery.
Outcome of this decision
Award debt and a 175 euro fee against XX. Refuse 65 euros in legal costs. The judgment is immediately enforceable.
Kreenholmi 12: debt case terminated after association waived its claim
Ruling · Viru Maakohus · First instance
Narva linn, Kreenholmi 12 Korteriühistu · 80508340
Entry into force has not been reverified
Participants and roles: Claimant — Narva linn, Kreenholmi 12 Korteriühistu; Defendant — XX
Editorial summary
The association waived its debt claim; the court terminated the case.
The dispute and the court’s decision
The court terminated proceedings to recover principal after Narva linn, Kreenholmi 12 Korteriühistu waived its claim against XX. The association was to receive a refund of 37,50 euros, half the fee paid.
The claim arrived on 17 September 2018 and was admitted on 4 October. On 30 November the association’s representative filed a waiver and requested half the fee back. The court accepted the waiver and ended proceedings on that ground.
The ruling does not state the reason for waiver or report payment of the debt by the defendant. The result is therefore termination of the case, rather than a new debt award or an established repayment. The act contains no separate allocation of costs between the parties.
Outcome of this decision
Terminate the claim proceedings. Order a refund of 37,50 euros in fees to the association.
Joala 11: case terminated after debt payment, only the state fee awarded
Ruling · Viru Maakohus · First instance
Narva linn, Joala tn 11 korteriühistu · 80189885
Entry into force has not been reverified
Participants and roles: Claimant — Narva linn, Joala tn 11 korteriühistu; Defendant — XX
Editorial summary
After debt payment, the association waived its claim; in the same ruling, the court awarded a 200 euro fee and refused 75 euros in legal costs.
The dispute and the court’s decision
The court accepted Narva linn, Joala tn 11 korteriühistu’s waiver of its claim against XX and terminated the case. A 200 euro fee was awarded against the defendant; reimbursement of 75 euros in legal costs was refused.
The association initially sought a payment order for debt. After the defendant objected, the case was transferred to ordinary claim proceedings. The association sought debt and alleged that the owner had not paid service and utility charges.
The association later reported that the defendant paid the debt in full after it applied to court. It therefore waived the claim but requested 275 euros in costs. The defendant submitted no written objections to the waiver or costs.
The court accepted the waiver and allocated costs to the defendant because the claim was satisfied after filing. Of the costs sought, it accepted the 200 euro fee as reimbursable. It did not award 75 euros in legal costs: a board member represented the association and it had no contractual representative. The court also explained that following such termination the same claim against the same defendant on the same grounds cannot be brought again. The act does not confirm payment of the awarded costs.
Outcome of this decision
Accept waiver and terminate proceedings. Award the association a 200 euro fee against XX; do not award 75 euros in legal costs.
Kerese 6: meeting decision on parking not declared void
Judgment · Tartu Ringkonnakohus · Appeal
Narva linn, P. Kerese tn 6 korteriühistu · 80183301
Entry into force has not been reverified
Participants and roles: Claimant and appellant – XX; Defendant – Narva linn, P. Kerese tn 6 korteriühistu
Editorial summary
Refusal to declare the parking decision void was upheld; land-use arrangements were not decided separately.
The dispute and the court’s decision
Tartu Ringkonnakohus dismissed XX’s appeal and upheld the refusal to declare the Narva linn, P. Kerese tn 6 korteriühistu meeting decision of 13 April 2016 void. Nullity would mean no legal effect from adoption; that specific demand was not granted.
The meeting decided to organise car parking on the green area behind the building. The claimant considered this construction of a car park involving tree felling and concreting, requiring all owners’ consent. She also relied on the lack of the necessary quorum. The association objected that organising parking was ordinary use of the land around the building and could be decided by majority.
The circuit court considered that the wording adopted was not yet a decision to build a car park and substantially alter the intended use of shared property. The claimant had not demonstrated grounds for nullity under the provisions on general meeting decisions. The court also stated that breach of co-owner consent rules does not itself make a meeting decision void.
The circuit court nevertheless corrected one first-instance argument. A court may and must check whether a statutory prohibition making the decision void was breached; it cannot confine itself to the label given to the demand. In this case, however, that examination did not change the outcome. The claimant had not brought a demand against the other owners to determine arrangements for use of the shared land, including tree felling.
The first-instance costs allocation was upheld, and appeal costs were imposed on the claimant. The county court will quantify them separately. The judgment concerns the specific meeting wording and ground of nullity raised; no separate demand on land-use arrangements was determined here.
Outcome of this decision
Dismiss XX’s appeal and leave the Viru Maakohus judgment of 8 June 2018 unchanged. Retain the previous costs allocation; the claimant bears appeal costs, to be quantified by the county court.

Parking on green space: limits of a meeting resolution
Judgment · Viru Maakohus Narva kohtumaja · First instance
Narva linn, P. Kerese tn 6 korteriühistu · 80183301
Entry into force has not been reverified
Participants and roles: Claimant — XX; Defendant — Narva linn, P. Kerese tn 6 korteriühistu
Editorial summary
XX sought nullity of a resolution to arrange parking behind the building. The court refused and stressed that the wording did not itself decide to build a parking area.
The dispute and the court’s decision
XX challenged the 13.04.2016 resolution of Narva linn, P. Kerese tn 6 korteriühistu to arrange parking on green space behind the building. XX considered it a material change in the shared land’s purpose requiring all owners’ consent. The association regarded resident parking as ordinary use.
The court addressed nullity specifically and found no convening defect or other applicable ground. A possible breach of shared-property management rules did not itself make the resolution void. A separate claim for invalidation on other grounds was not determined here.
Nor did the court find that the wording already meant construction of a parking area: paving, tree removal or other specific works were not identified. The materials did not prove a material change of purpose. The claim was dismissed and costs imposed on XX, with their amount to be determined separately. The act is not permission for any works and does not allocate individual parking spaces.
Outcome of this decision
The claim to declare the 13.04.2016 resolution void was dismissed. The court did not find that construction had already been approved. XX bears their own and the association’s costs, the latter to be fixed separately.
Kreenholmi 12: claim refused admission because association did not clarify from whom it sought the debt
Ruling · Viru Maakohus · First instance
Narva Linn, Kreenholmi 12 korteriühistu · 80508340
Entry into force has not been reverified
Participants and roles: Claimant – Narva Linn, Kreenholmi 12 korteriühistu; Two different individuals were named in the claim documents – XX and XX
Editorial summary
Different defendants were named in the debt claim; the required clarifications were not received.
The dispute and the court’s decision
The court refused to accept the claim for proceedings by Narva Linn, Kreenholmi 12 korteriühistu: the documents named different persons, and the association did not clear up that ambiguity in the time allowed.
The defendant details and account of the circumstances referred to one person, but the relief sought requested debt recovery from another. The association did not explain why the second person should pay or supply sufficient identifying information for that person.
On 19 September 2018, the court required defects to be remedied and allowed 14 days from service of the ruling for correction. The representative received it on 5 October; the defects were not remedied by 19 October. Other defects in the account of the claim’s circumstances also remained uncorrected.
The court therefore refused to accept the claim for proceedings and explained return of the application and attachments. The ruling determines whether the filed documents were suitable to start the case. The amount of debt and any particular person’s obligation to pay were not established on their merits.
Outcome of this decision
Refuse to accept the claim for proceedings because defects concerning the defendant’s identity and circumstances of the demand were not remedied.
Kangelaste 18a: debt claim refused admission because a deceased person was named as defendant
Ruling · Viru Maakohus · First instance
KÜ Narva linn, Kangelaste prospekt 18a · 80170383
Entry into force has not been reverified
Participants and roles: Claimant – KÜ Narva linn, Kangelaste prospekt 18a; Person named as defendant – XX
Editorial summary
The claim was brought against a deceased person; the court refused to accept it for proceedings without deciding the debt on its merits.
The dispute and the court’s decision
The court refused to accept for proceedings the claim by KÜ Narva linn, Kangelaste prospekt 18a to recover a debt from XX. On examining the application, the court established from the population register that the named defendant had died.
The association went to court on 17 September 2018. The court explained that an individual’s capacity to have civil rights and obligations ends at death, so the claim against this defendant could not achieve the result sought. That was the reason for refusing acceptance.
The court also explained the association’s right to request a refund of the court fee paid separately. The operative part specifies neither the fee amount nor a refund.
The existence and amount of debt were not examined on their merits. This ruling did not determine the liability of other persons, including through inheritance.
Outcome of this decision
Refuse to accept the debt claim for proceedings. Explain the association’s right to make a separate application for a court fee refund.
Kangelaste 3: dispute over nullity of a meeting decision ended after waiver of the claim
Ruling · Viru Maakohus · First instance
OÜ Rosehill · Korteriühistu Kangelaste 3 · 10972543 · 80162521
Entry into force has not been reverified
Participants and roles: Claimant – OÜ Rosehill; Defendant – Korteriühistu Kangelaste 3
Editorial summary
The company waived its demand for a declaration that part of the meeting decision was void; the court concluded the case.
The dispute and the court’s decision
The court terminated OÜ Rosehill’s case against Korteriühistu Kangelaste 3 after the company waived its demand. The company had sought a declaration of partial nullity of the general meeting decision of 4 October 2017, meaning no legal effect for the challenged part from adoption.
On 11 September 2018, the claimant applied to end the case and requested reimbursement of half the court fee. The association agreed to termination. The court accepted the waiver and ordered a refund to the company of 150 euros out of the 300-euro fee paid.
This ruling does not disclose the substance of the challenged part or why the demand was waived. It did not establish nullity of the meeting decision. The court explained a different consequence of accepting the waiver: the same claimant cannot bring the same claim against the same defendant on the same grounds again.
Outcome of this decision
Accept the waiver and terminate proceedings. Order a court fee refund of 150 euros to OÜ Rosehill.

The insurer’s claim was granted; the judgment copy contains an operative part without circumstances or reasons.
The dispute and the court’s decision
Viru Maakohus granted the claim by AAS BTA Baltic Insurance Company Eesti filiaal against Narva linn, Rahu tn 28a korteriühistu and awarded the insurer 1 218,79 euros in damages. It also awarded 425 euros in litigation costs against the association, which must bear its own costs as well.
The judgment was made under the simplified procedure and gives the result without an account of the circumstances or reasons. The operative part describes recovery as a recourse claim: the insurer’s demand to be reimbursed for the damage amount. The text does not show what happened, what evidence was examined or what the association argued in response. The specific basis for its liability is therefore not set out here.
The court did not grant separate leave to appeal but explained that an appeal was possible for substantial and clear errors in law or assessment of evidence. A participant first had to notify the court of an intention to appeal within ten days of service of the operative part. The court would then supplement the judgment with an account of the circumstances and reasons. The judgment does not establish actual payment of the awarded sums.
Outcome of this decision
Award the insurer 1 218,79 euros in damages and 425 euros in litigation costs against the association. The association bears its own costs.

Editorial summary
Denied access required examination of the association’s further steps to maintain the common riser.
The dispute and the court’s decision
KORTERIÜHISTU RAHU 28A (now — Narva linn, Rahu tn 28a korteriühistu). AAS BTA Baltic Insurance Company Eesti filiaal sought reimbursement of 1218 euros and 79 cents paid for water damage from KORTERIÜHISTU RAHU 28A. The parties did not dispute the leak from a valve on the common hot-water riser or the insurance payment. The association relied on owner XX having denied access during earlier repairs and disputed the amount of loss. The first-instance court dismissed the claim.
The appellate court reversed and remitted the case to the preliminary stage. Having no right to enter without consent does not itself establish compliance with all duties to maintain common property. Further measures needed examination, including convening a meeting, taking decisions or other steps to address denied access. Failure to act may give rise to liability; the first-instance court also failed to justify excusing a possible breach.
Important documents required Estonian translations even in simplified proceedings. The parties must have an opportunity to present evidence with the burden of proof properly allocated. If a breach is established, the compensation claim could have passed to the insurer following payment; association liability does not exclude liability of an owner who breached duties. The amount of loss had not been assessed and requires examination. The appeal was allowed in part; the first-instance court will allocate costs according to the new outcome.
Outcome of this decision
The dismissal was reversed and the case remitted to the preliminary stage; breach and the amount of loss remain to be established.

Editorial summary
The association sought additional water debt of a former owner from the purchaser after auction. The court refused recovery on good-faith grounds and inadequate proof of the calculation; it did not establish limitation.
The dispute and the court’s decision
Narva linn, 26. juuli tn 7 korteriühistu, formerly KORTERIÜHISTU 26. JUULI 7 NARVA, sought a former owner’s debt and late-payment interest from purchaser XX. A meter check after the auction revealed differences from previously reported water readings. The purchaser objected that the debt disclosed at purchase had been paid and that the association had not notified the bailiff of the additional claim beforehand.
Applying the law in force when the obligations arose, the court accepted the good-faith objection. It found that the association had not properly checked the data over a prolonged period or explained why the extra debt was not identified before sale. On these facts, later claiming it from this purchaser was inconsistent conduct.
The documents also did not allow verification of monthly charges, payments and late-payment interest. The court could not therefore establish when obligations became due or decide the limitation defence. Dismissal was not based on a finding that the whole claim was time-barred. Debt and late-payment interest were refused. The association must bear its own, the defendant’s and the third party’s costs, with amounts determined separately.
Outcome of this decision
The additional debt and late-payment interest claim was dismissed. The court found recovery from this purchaser contrary to good faith and the calculation insufficiently proved; limitation was not established. The association bears participants’ costs as ordered, with their amount fixed separately.

Editorial summary
The circuit court examined the reopening application instead of leaving it unexamined, but found no grounds to reopen the case.
The dispute and the court’s decision
Tartu Ringkonnakohus changed the procedural outcome but did not reopen XX’s case against Narva linn, Tallinna mnt 33 korteriühistu. Instead of leaving the reopening application unexamined, it examined and rejected it. The main claim remained unexamined.
The claimant challenged meeting decisions of 10 May 2017 on replacing water pipes using an unnamed company, owners providing telephone numbers, and a contract with a lawyer. The court initially granted the claim by default but reopened proceedings after the association applied to set aside the default judgment (kaja). The claimant and representative then failed to attend the hearing on 15 May 2018. At the association’s request, the court left the claim unexamined.
The claimant requested reopening, arguing that the representative had not been sent a separate summons and therefore did not know about the hearing. The claimant also denied that the association had requested leaving the claim unexamined. The association opposed the appeal, arguing among other things that it was late.
The circuit court found that the summons was sent to the claimant before the court was notified of the representative. The claimant received it personally, and on the day the representative notified the court of their authority, the representative obtained electronic access to all materials, including the summons. In those circumstances, the court did not have to send the same summons again. The association’s request to leave the claim unexamined was recorded in the minutes. The claimant did not substantiate a valid reason for absence or an inability to report it in time.
However, the court found it wrong to refuse to examine the reopening application merely because it had been filed before the ruling was put in writing: the participant already knew the decision announced at the hearing. It remedied the defect itself, examined the application and refused reopening. The remainder was upheld and appeal costs allocated to the claimant; the county court will determine the amount separately. The meeting decisions’ validity was not determined on the merits by this ruling.
Outcome of this decision
Set aside the ruling of 25 May 2018 only insofar as it left the reopening application unexamined. Issue a new ruling in that part refusing reopening. Uphold the remainder; XX bears appeal costs.

Editorial summary
After XX did not attend, the claim against the association was left unexamined. The appellate court later changed only the ruling on restoration: it examined and refused that request without deciding the meeting-resolution dispute on its merits.
The dispute and the court’s decision
XX sued Narva linn, Tallinna mnt 33 korteriühistu, formerly Korteriühistu Punane Maja, to invalidate meeting resolutions of 10.05.2017. The preserved subsequent order states that the disputed resolutions concerned a contract to replace water pipes, requiring owners to provide telephone numbers, and a contract for legal services. After XX and their representative did not attend, the court granted the association’s request to leave the claim unexamined. XX objected that the representative had not received a separate summons and the case could not be disposed of this way.
The court found that XX had personally received the summons before notifying a new representative. Documents, including the summons, were then made available to the representative electronically. The court considered notice proper. The hearing record confirmed the association’s request, so the court had not acted of its own initiative. No sufficient excuse for absence or request to hear the case without XX was established.
The objection was rejected. The restoration request was left unexamined as filed before a written order and its service. The claim itself was also left unexamined, not dismissed on its merits. Costs were imposed on XX, to be fixed separately. Later, on 3 September 2018, Tartu Ringkonnakohus changed only the ruling on the request to restore proceedings: the request had to be examined, but was refused. The claim remained unexamined, the other parts of the order were upheld, and XX bears the appeal costs.
Outcome of this decision
Initially, the procedural objection was refused and the restoration request and claim were left unexamined. On 3 September 2018, Tartu Ringkonnakohus changed only the restoration ruling: the request was examined but refused. The other parts of the order, including leaving the claim unexamined, were upheld. XX bears appeal costs; the substantive validity of the meeting resolutions was not decided.

Editorial summary
The administrative court returned the complaint: the commission’s documents created no binding rules for outside persons.
The dispute and the court’s decision
Tartu Halduskohus returned the apartment association Võidu 9 Narva’s complaint against city traffic safety commission decisions and a response from Narva Linnavalitsus. It found that the documents were not binding administrative acts and a dispute over use of a private road fell outside administrative court jurisdiction.
The association sought annulment of item 5 of the commission decision of 1 August 2017, item 2 of the decision of 7 February 2018 and the city government’s response to an objection of 11 May 2018. It initially also sought restoration of the earlier traffic scheme between Võidu 7 and Võidu 9. It argued that the courtyard road lay on two private plots and the commission had disregarded its rights. The city government objected that the administrative court could not hear such a dispute.
The court found that commission minutes had no direct binding effect on outside persons. The city government’s response merely explained that status and therefore was not subject to annulment as an administrative act either.
The court considered that private parties’ road use and property access issues should be resolved by agreement or civil litigation. Narva linn did not own the private roads identified or bear responsibility for their upkeep. Returning the complaint did not establish a final traffic arrangement between plots or require the city to restore the earlier scheme.
Outcome of this decision
Return the complaint in the administrative case because the administrative court lacks jurisdiction to resolve this dispute.
