The dispute and the court’s decision
Narva linn, Kangelaste prospekt 49 korteriühistu, named in the source as Korteriühistu Kangelaste 49, brought a 2260.85-euro claim against Narva linn for management costs of an apartment owned by the city. The parties settled.
The association withdrew its action, and the city acknowledged a monetary obligation for management costs. It undertook to pay the debt existing when the apartment was disposed of, plus statutory interest, no later than 30 days after disposal under the city’s applicable procedure. The deadline runs from sale or other disposal, not the date of the court order; the final amount is tied to that future point.
The court found the agreement lawful and capable of performance, approved it and terminated proceedings. Each side bears its own costs; the association was ordered a 239.67-euro fee refund. The appeal deadline was shortened to one day from service. Disposal, payment and entry into force have not been reverified.
Outcome of this decision
The approved settlement requires Narva linn to pay the apartment debt existing at disposal and interest within 30 days after disposal. Proceedings ended; a 239.67-euro fee refund was ordered for the association.

Narva linn, Kangelaste prospekt 9 korteriühistu, named in the source as KÜ Kangelaste 9, leased non-residential premises to defendant XX. Payments under the lease of 22 June 2009 had only partly been made. The association sought 712.98 euros in outstanding debt, 658.10 euros in late-payment interest and litigation costs.
The parties agreed that the defendant would pay the 712.98-euro debt and 446 euros in interest within five days. Finding no conflict with law or good morals, the court approved the agreement and terminated proceedings. This was a negotiated outcome, rather than a merits ruling granting the original interest claim in full.
The court explained the association’s right to apply for a refund of half the court fee but did not order a refund in this decision. Performance, entry into force and subsequent appeals have not been reverified.
Outcome of this decision
The approved settlement requires payment of 712.98 euros in debt and 446 euros in interest within five days. Proceedings ended; the court only explained the right to request a fee refund.

The dispute and the court’s decision
Claimant XX sought to have a general meeting decision of the apartment association Narva Sõbralik (now — Narva linn, A. Puškini tn 2a korteriühistu) set aside. The claimant then filed a notice of waiver of the claim. The association was notified, raised no objection and agreed to termination of the proceedings. This order does not describe the substantive objections to the meeting decision.
The court found the waiver admissible and compatible with the law and the public interest, accepted it, and terminated the case without a decision on the merits by its order of 26 April 2011. The act therefore confirms neither the lawfulness of the meeting decision nor the merits of claimant XX’s original objections.
All costs were left to claimant XX. However, the association did not seek reimbursement of its costs, and the operative part expressly states that there are no costs to be recovered. No money was awarded to the association. The court explained that, after termination following waiver, a claim with the same subject matter and grounds cannot be brought again against the same defendant. This is a procedural consequence of waiving the claim, rather than a separate examination of the circumstances of the meeting.
Outcome of this decision
Terminate the proceedings challenging the association’s meeting decision following acceptance of claimant XX’s waiver of the claim. Leave costs to claimant XX; there are no costs to be recovered.

The dispute and the court’s decision
Narva linn, Rahu tn 28 korteriühistu, named in the source as Korteriühistu Rahu 28, sought debt and interest from defendant XX. It reported that the claim had been satisfied after the action was filed and withdrew. Finding no conflict with law or the public interest, the court accepted withdrawal and terminated proceedings.
Because payment followed the filing of the action, costs were allocated to the defendant. The court awarded 99.70 euros, corresponding to the 1560 kroons stated in the decision: half the fee and legal assistance. This was an award of costs, not a second award of the paid debt.
The association’s earlier request for public service was refused because the court found that the documents had already been served personally. Actual payment of the awarded costs, entry into force and subsequent appeals have not been reverified.
Outcome of this decision
Proceedings ended following withdrawal. The defendant was ordered to pay 99.70 euros in costs; public service was refused because personal service had already occurred.

The dispute and the court’s decision
Narva linn, Kangelaste prospekt 14 korteriühistu, named in the source as Korteriühistu Kangelaste 14, sued defendant XX for debt. Under the approved settlement, the defendant acknowledged 564.68 euros in debt, 66 euros in interest and 172.56 euros in costs, totalling 802.56* euros.
The defendant undertook to pay 125 euros each month by the deadline on the association’s bill. Current monthly building charges are paid first from that sum; only the remainder reduces the earlier 802.56*-euro debt. If two months’ payments are unpaid, the association may seek immediate enforcement of the entire remaining balance through a bailiff.
The court found the settlement lawful and capable of performance, approved it and terminated proceedings. The agreed 172.56 euros in costs include half the court fee and legal expenses; each party bears its other costs. The parties waived appeal against the order. Performance and entry into force have not been reverified.
Outcome of this decision
The court approved the 802.56*-euro settlement and terminated proceedings. Monthly payments of 125 euros cover current bills first and old debt only from the balance; two unpaid monthly payments allow immediate recovery of the entire remainder.

The dispute and the court’s decision
KÜ Puškini 10 (now — Narva linn, A. Puškini tn 10 korteriühistu). KÜ Puškini 10 claimed management and utility charges from OÜ Analan Auto. On 14 May 2010 Tartu Ringkonnakohus overturned the initial refusal of 18 December 2009 and remitted the case to establish the amount of costs. On rehearing, the court examined the charter, tariff and roof-repair decisions, corrected bills and a consolidated calculation. The company disputed the basis of charges and treated its payments as water payments. The court affirmed the non-residential owner’s common-cost obligations, found the claim proved and found the alleged water payments unsupported by the required evidence. The claim was allowed for 3,114.73* euros. The new reasoning states that no late-payment interest was claimed. Costs were imposed on the company without fixing their amount separately.
Outcome of this decision
3,114.73* euros awarded; company bears costs, whose amount was not separately fixed.
