  • Claimant KÜ Tallinna 44 – sought the special contribution.
  • Defendant XX – disputed the basis for the contribution and late-payment interest.

The dispute and the court’s decision

The association sought an unpaid special contribution for replacing electrical panels, set by the meeting of 4 May 2011. The defendant argued that an equal contribution was inconsistent with the floor-area allocation in the articles, that no separate decision authorised late-payment interest, and that less had been spent on the work than collected. On 11 July 2014, the court granted the claim in an abbreviated judgment. After the defendant announced an intention to appeal, the court added the account of the case and its reasons. The award remained unchanged. The court found that the decision establishing the contribution had not been challenged and remained binding on the defendant. The unpaid 40 euros was supported by the calculation, accounts and minutes. The defendant had attended the meeting and received invoices stating a payment deadline of 30 November 2011. A total of 4 400 euros was collected for replacing the panels and 3 669,31 euros spent. The court concluded that the balance had been carried into the following year’s plan; the defendant had not challenged the decisions approving the report and plan either. The court derived the board’s right to charge late-payment interest from the law, so it did not require a separate meeting decision. The award comprised a 40-euro contribution and 7,16 euros in late-payment interest as at 1 May 2013, totalling 47,16 euros. Costs awarded were 60 euros in court fees and 130 euros for legal assistance, totalling 190 euros. The part of the court fee paid above the necessary amount was not imposed on the defendant: the claimant was informed of the right to seek reimbursement from the state budget.

Outcome of this decision

Supplement the judgment of 11 July 2014 with an account of the case and reasons. Order defendant XX to pay the apartment association Tallinna 44 a debt of 40 euros, 7,16 euros in late-payment interest and 190 euros in costs.

The dispute and the court’s decision

The proceedings on the association’s debt claim had been suspended at the parties’ request by a ruling of 7 April 2014. On 9 September, they requested termination of the case on settlement terms. The association waived its claim and the defendant supported the waiver. The parties confirmed that they had no mutual claims concerning the subject matter of this case and that each would bear its own costs. The court found the agreement lawful, enforceable and compatible with the public interest. It resumed the proceedings to approve the agreement and then terminated them. The court ordered a refund to the association of 239,67 euros*, half the state fee paid of 479,33 euros, after the ruling entered into force. The ruling contains no independent finding on the merits of the original debt claim. Performance of the refund is not confirmed.

Outcome of this decision

Resume the proceedings, approve the agreement on waiver of the claim and the absence of mutual claims, and terminate the case. Leave each party to bear its own costs; refund the association 239,67 euros* in state fees after the ruling enters into force.

The dispute and the court’s decision

KÜ Kangelaste 3 sought service-charge arrears from XX under rates approved by general meetings: 10.00 kroons/m² (0.64 euros/m²), later 12.20 kroons/m² (0.78 euros/m²). The county court stayed the case because separate proceedings concerned the nullity of the general meeting decision of 3 November 2009. The association argued that its claim did not rely solely on that decision and that the nullity objection could be addressed within the debt case. The defendant supported waiting for the separate case and disputed the later confirmation of the rates. The circuit court set aside the stay. Nullity of a general meeting decision can be raised either by a claim or as a defence, so the county court must examine those grounds within this debt case. The case was returned for continuation. This order decided neither the debt nor the validity of the rates. The county court was to allocate costs when dealing with the merits.

Outcome of this decision

The county court stay order of 7 April 2014 was set aside and the case returned for continuation. The debt claim was not determined on its merits. Costs remained for the county court to decide.

The dispute and the court’s decision

KÜ Kangelaste 3 brought debt claims against several defendants. It then withdrew its claims against four of them, and those claims were left unexamined on 31 August 2012. Their costs were allocated to the association. The county court later determined recoverable representation costs of 599.98 euros. The association sought a reduction, disputing the initial consultation, the representative’s authority and the amount of work. It also argued for splitting the common representative’s costs equally between one defendant and the other four. The circuit court found no reason to interfere with the county court’s assessment. The relevant authority existed at the consultation; later notification to the court did not make the expense unjustified. The claims against different defendants rested on different legal grounds, so all the assistance could not be treated as overlapping. The representative had to be ready to protect the four defendants throughout the hearing. The hearing record did not support the allegation that an adjournment resulted from the representative being unprepared: the parties were given time to examine new evidence. The costs order and the 599.98-euro award remained unchanged. The association’s appeal was dismissed and the parties bore their own appeal costs. This order did not determine the remaining underlying claim.

Outcome of this decision

The county court order of 11 September 2013 remained unchanged and the association’s appeal against it was dismissed. The four defendants’ costs award of 599.98 euros against the association was maintained. Each participant bore their own appeal costs.

The dispute and the court’s decision

Rosehill sought a declaration that the association’s meeting decision of 3 November 2009 was void, meaning it had no legal effect from adoption. On 9 September 2014, the parties asked to conclude the case by agreement. Under the agreed terms, the claimant waives the claim and the defendant supports the waiver. The parties confirm that they have no mutual claims concerning the subject matter of this case, and each bears its own costs. The court considered the agreement lawful, enforceable and consistent with the public interest, approved it and terminated proceedings. This ruling did not establish that the meeting decision was void: the dispute ended by agreement. After the ruling becomes final, the claimant is entitled to a refund of 125 euros, half the 250-euro court fee paid. The source does not confirm an actual refund.

Outcome of this decision

Approve the agreement on Rosehill’s waiver of the claim, absence of mutual claims in the case, and each party bearing its own costs. Terminate proceedings; refund the claimant 125 euros in court fees after the ruling becomes final.

  • Claimant and appellant XX – challenged the cost allocation arrangement.
  • Defendant KORTERIÜHISTU VANA LOSS – defended the meeting decision.

The dispute and the court’s decision

The claimant challenged item 2 of the meeting decision of 22 August 2012, which changed the rules in the articles of association for allocating utility expenses, including heating. The claimant argued that the new arrangement unjustifiably increased charges for premises fully connected to central heating and favoured another owner. The association opposed the claim and also relied on a later meeting decision. The first-instance court dismissed the claim, but applied rules on invalidating a decision without examining the arguments about conflict with good morals and good faith on their merits. The appeal court noted that the claimant had specifically sought a declaration of nullity: absence of legal effect from adoption. Subsequent confirmation of the decision did not itself remove the right to rely on nullity, and the voting majority was not in dispute. The appeal court examined the grounds raised but did not find them established. The rules in force allowed the articles to allocate costs differently from a floor-area calculation. Higher charges for some owners did not in themselves mean a conflict with good morals. In this case, the court took account of the fact that the non-residential premises were used as a shop and did not require the same temperature as a home. The alleged omission of the claimant’s objections from the minutes was likewise not considered a ground for nullity. The court agreed that the request to join other owners had not been properly determined, but found that this had not affected the result: a judgment in such a dispute applies to association members regardless of their participation in proceedings. The appeal was dismissed. The operative part of the first judgment was upheld and costs at both levels were imposed on the claimant. Another judgment concerning the meeting of 20 December 2012 was dealt with separately and, according to this source, was already final when this case was considered.

Outcome of this decision

Dismiss claimant XX’s appeal and uphold the operative part of the Viru Maakohus judgment of 9 October 2013, changing its legal reasoning in part. The claimant must bear costs at both levels.

The dispute and the court’s decision

XX sued Tallinna mnt 42 KÜ (now — Narva linn, Tallinna mnt 42 korteriühistu), seeking a declaration of no debt and recalculation of management and utility payments. XX alleged that the association used an incorrect floor area and imposed an additional heating charge after changes to the heating system, also referring to board permission. These were the claimant’s allegations, not breaches established by the court. XX supplemented the claim after being given time to clarify it, but the court refused admission because the claim could not achieve its stated purpose. The charges relied on board and general-meeting decisions. XX considered those decisions void, but gave no grounds or supporting facts for nullity and did not wish to challenge them. The court referred to the binding nature of association decisions on management costs and found the claim insufficient for the requested result. No debt was awarded on its merits and no absence of debt was declared: the case was not admitted. All costs were imposed on XX. The court explained the right to apply separately for a refund of the paid state fee. An interlocutory appeal lies to Tartu Ringkonnakohus through Viru Maakohus within 15 days after service, no later than five months after the order. The source establishes no subsequent acts.

Outcome of this decision

Admission of the claim for a declaration of no debt and recalculation was refused. XX bears the costs; the right to request a state-fee refund was explained. Neither the merits of the debt nor unlawful heating charges were established by this act.

On 9 September, the parties submitted an agreement to end the dispute. Both claimants waived their claims and the association supported the waiver. The parties confirmed that they had no mutual claims in this case and agreed to bear their own costs. The court considered the terms lawful, enforceable and consistent with the public interest, approved the agreement and terminated proceedings. This ruling did not invalidate the meeting decisions. Rosehill was awarded a refund of 125 euros, half its 250-euro court fee, once the ruling became final. Claimant XX had previously been exempted from the fee, so XX’s refund request was refused. The dispute and the court’s decision

The association had previously brought a debt claim against XX. According to the history described in this act, the claim was dismissed, that dismissal was upheld on appeal and costs were allocated to the association. The defendant then applied for recoverable representation costs of 620 euros. The first award of 333 euros was set aside on procedural grounds and remitted for reconsideration; on 21 April 2014, the county court again awarded 333 euros. The defendant appealed regarding the amount not awarded. In the present ruling, the court found a further 78 euros justified for assistance in preparing the defence: 1,3 hours at 60 euros. The fact that the participant signed the document personally did not rule out work by a representative. The file contained a power of attorney, confirmation from the participant and the representative’s signatures on attachments, which the court considered sufficient. Other disputed costs, including 140 and 60 euros for separate documents, were not accepted: representation at the relevant stage had not been proved, and one document went beyond the explanations permitted. The first-instance ruling was set aside as to the amount, and 411 euros was awarded instead of 333 euros. The association’s argument about maximum rates was rejected by reference to the relevant rules having been declared unconstitutional. The costs of this appeal against the ruling are not reimbursed separately. The underlying debt is not reconsidered in this act.

Outcome of this decision

Set aside the Viru Maakohus ruling of 21 April 2014 as to the amount of costs and order the apartment association Tallinna mnt 21 Narva to pay defendant XX 411 euros. Do not reimburse the costs of the present appeal against the ruling.

The dispute and the court’s decision

After the association’s debt claim, XX sought a determination of recoverable representation costs. Costs in the county and circuit courts had previously been allocated to KÜ Tallinna mnt 21 Narva. The county court allowed the costs application only in part. The parties disputed the representative’s work, proof of involvement, necessity and the applicable recovery limit. XX appealed against the refusal to allow the remainder. The circuit court set aside the order of 5 December 2013 for a reason independent of the appeal arguments: a judicial lawyer, rather than a judge, had determined the costs. Relying on the Supreme Court decision of 4 February 2014, the court explained that determining recoverable costs constitutes the administration of justice, not a technical calculation. It involves assessing the necessity and reasonableness of representation, the complexity of the case and the time spent. A judge must make that assessment. A judge’s later forwarding of the appeal did not replace participation in deciding the costs application. The application was returned for a fresh hearing. Individual cost items and the underlying debt dispute were not decided by this order.

Outcome of this decision

The county court order of 5 December 2013 was set aside and XX’s application to determine recoverable costs returned for a fresh hearing. The individual arguments about costs were not determined on their merits.

The dispute and the court’s decision

KÜ Tallinna mnt 21 sought management-charge arrears and late-payment interest from XX. XX denied the debt and referred to payments, disputed interest and amounts from an earlier court case appearing in the calculations. The county court dismissed the claim because the association had not produced a clear, verifiable calculation. The circuit court agreed. The documents gave inconsistent figures for principal and interest, and the period during which the alleged debt arose remained unclear. Opportunities to clarify the claim, additional tables and a reduction did not explain how the balance developed. The court did not consider it inherently impermissible to show previously adjudicated amounts on an invoice or to follow the statutory payment-allocation sequence where the parties had not designated an obligation. But that did not make this claim clear. The court did not simply establish double recovery: the calculation also covered the earlier case period and did not allow the new claim to be traced. The association had not credibly rebutted XX’s objections, calculations and evidence of payments. The judgment of 15 October 2012 remained unchanged and the appeal was dismissed. Costs in both courts were allocated to the association. The result concerns the claim examined, rather than all possible future charges.

Outcome of this decision

The county court judgment of 15 October 2012 remained unchanged and the association’s appeal was dismissed. No award was made on the claim examined. County and circuit court costs were allocated to the association.

The dispute and the court’s decision

KÜ Tallinna mnt 21 Narva claimed a debt from XX. During the proceedings it revised the principal claim and withdrew its entire late-payment interest claim. XX argued that current payments had been made and that the new calculation repeated sums and costs already awarded in another case and subject to enforcement. The court dismissed the claim in full. It found that the calculation did include sums from the earlier case while enforcement of that award was taking place. An already adjudicated claim could not be decided again in these proceedings. Despite an opportunity to clarify the claim, the association did not isolate and substantiate a specific new debt with proper supporting documents. An account statement also confirmed substantial payments during the disputed period. The association acknowledged regular receipts but had not kept track of their total. The evidence did not establish the existence and amount of the claimed balance unambiguously. This judgment neither sets aside the earlier award nor declares that all future obligations to the association are absent. The association bears all proceedings costs, without an amount being fixed. No late-payment interest was awarded after the association withdrew that part of its claim.

Outcome of this decision

The debt claim was dismissed for lack of a specific, substantiated calculation. The association withdrew the interest claim and bears all costs. The earlier award was not set aside.

The dispute and the court’s decision

The original dispute between OÜ Rosehill and claimant XX on one side and the association on the other concerned meeting decisions. According to the history in this act, the claims had previously been granted by default judgment, and reasons were later added to that judgment; the subsequent dispute concerned the amount of costs to be reimbursed. The claimants sought 1 551,64 euros: 255,64 euros in state fees and 1 296 euros for legal assistance. On 28 April 2014, the county court awarded 974,92 euros. Following the association’s appeal, the appeal court reduced the amount to 867,03 euros on 22 August 2014. On 9 September, the parties submitted an agreement under which the claimants withdrew their application to determine costs and the association supported the withdrawal. Each participant was to bear its own costs, with no remaining mutual costs claims in this case. The court found the agreement lawful and enforceable, approved it and terminated the costs determination proceedings. It also set aside both rulings mentioned above. This act did not set aside the earlier judgment on the meeting dispute. The previously determined 974,92 and 867,03 euros are not new awards under the agreement.

Outcome of this decision

Set aside the rulings of 28 April 2014 and 22 August 2014. Approve the claimants’ withdrawal of their application to determine costs and the term requiring the parties to bear their own costs; terminate these proceedings.

The dispute and the court’s decision

OÜ Rosehill and XX sought a declaration that decisions of KÜ Kangelaste 3’s general meeting of 16 November 2011 were void. The county court had granted the claim by default because the association did not respond in time. The association sought to reopen the case and appealed against the refusal of 14 August 2013. It argued that the claim lacked legal justification, the claimants had not explained their legal interest and the wrong articles of association had been used. It also relied on circumstances concerning the organisation of legal assistance. The circuit court did not accept those circumstances as a valid reason for failing to respond. It stressed that even a default judgment requires the court to examine whether the claim is legally justified, using the factual allegations treated as admitted under the applicable default procedure. Members’ legal interest in establishing the nullity of association decisions could be presumed, but the claim’s subject and grounds still required justification. As the allegation of defective convening was treated as admitted, the court considered the claim justified. Convening had to be assessed against the articles in force at that time. The refusal to reopen remained unchanged and the association’s appeal was dismissed. Appeal costs were allocated to the association without fixing their amount.

Outcome of this decision

The county court order of 14 August 2013 remained unchanged and the association’s appeal was dismissed. The proceedings were not reopened. Appeal costs were allocated to the association; their amount was not determined by this order.

The dispute and the court’s decision

XX and OÜ Rosehill sought a declaration that Korteriühistu Kangelaste 3’s meeting decisions were void from the outset. The association did not respond within the time allowed after service of the claim. The court had previously granted the claim by a default judgment without a factual account or reasons. After the association indicated an intention to file a kaja application to reopen the case, the court supplied those missing parts. The supplementary judgment preserves the declaration that all decisions of the meeting of 16 November 2011 are void. The court relied on defective convening: the claimants alleged that unauthorised people called the meeting and that notice was given only 6 days beforehand rather than the 15 days required by the articles. With no timely response, the court treated those factual allegations as admitted by the association. It did not separately assess the allegation that one owner received two votes. The convening defect already sufficed to invalidate all decisions. The judgment therefore does not contain a separate finding that voting was unlawful. The association bears all costs, without an amount being fixed. The judgment was declared immediately enforceable; actual enforcement was not established. The supplementary judgment forms part of the earlier default judgment and does not decide a different dispute anew.

Outcome of this decision

The default judgment was supplemented with facts and reasons without changing its result. All decisions of the meeting of 16 November 2011 were declared void for defective convening. The association bears costs; the judgment is immediately enforceable.

The dispute and the court’s decision

On the claim brought by XX and OÜ Rosehill, the court declared all decisions of Korteriühistu Kangelaste 3’s general meeting of 16 November 2011 void by default judgment. Being void means having no legal effect from the outset. The association was ordered to bear all proceedings costs, without an amount being fixed. The judgment was declared immediately enforceable. This short judgment has no factual account or reasons. It does not disclose the specific substance of the meeting decisions or evidence of defects, nor establish that every allegation was examined in adversarial proceedings. It records the claim’s success by default and the available review procedures. The association was told of its right to file a kaja application to reopen the case, while the claimants were told of an appeal. A party intending to seek review could request the missing facts and reasons. On 16 May 2012 the court supplied the missing factual account and reasons. The supplement based nullity on defective convening: with no response, allegations of unauthorised organisers and notice of 6 days rather than the 15 required by the articles were treated as admitted. The allegation that one owner received two votes was not assessed separately. Supplementation does not itself mean that the case was reopened or the original result reversed. Actual enforcement was not established.

Outcome of this decision

The claim was granted by default: all decisions of the meeting of 16 November 2011 were declared void. The association bears costs and the judgment is immediately enforceable. No monetary costs figure was fixed.

The dispute and the court’s decision

Two claimants XX sought a declaration that the general meeting decisions of KÜ Kangelaste 3, now Narva linn, Kangelaste prospekt 3 korteriühistu, of 12 October 2012 were void. Voidness means lacking legal effect from the outset. The claimants appealed after Viru Maakohus’s judgment of 9 December 2013. This order does not explain the substance of the disputed meeting decisions. During the appeal the parties settled: the claimants withdrew their claim with the association’s consent, and the participants confirmed that they had no mutual claims arising from this case. The court found the agreement lawful and capable of performance, without harm to an important public interest. It therefore set aside the earlier judgment and terminated proceedings. This order did not determine the lawfulness of the meeting decisions on the merits. Each participant bears their own litigation costs. The court ordered the refund of 125 euros, half the appeal fee, but refused to refund half the first-instance fee. The parties agreed on a two-day deadline from service for appealing the order. Further appeals and entry into force have not been reverified.

Outcome of this decision

The settlement was approved, the judgment of Viru Maakohus of 9 December 2013 was set aside, and proceedings were terminated. Each participant bears their own costs; 125 euros of the appeal fee was ordered refunded, while refund of the first-instance fee was refused.

The dispute and the court’s decision

Three individuals XX sought the appointment of a board member for KÜ Kangelaste 3, now Narva linn, Kangelaste prospekt 3 korteriühistu. Following Viru Maakohus’s order of 25 March 2014 and its appellate review, the participants asked the court to approve an agreement ending the dispute. The court refused to approve a settlement because, in these non-contentious proceedings, the applicants could not freely dispose of the right forming the subject of the application. The document nevertheless amounted to a withdrawal that could be accepted. The county court had already accepted one applicant’s withdrawal; the circuit court now accepted the other two applicants’ withdrawal. Proceedings were terminated and the orders of 25 March and 2 September 2014 were set aside. Each participant bears their own costs. The court ordered a refund of 12.50 euros to one applicant, half the fee for the appeal against the order, but refused to refund half the first-instance fees. The agreed appeal deadline was two days from service. Entry into force has not been reverified.

Outcome of this decision

Approval of the settlement was refused, but the two remaining applicants’ withdrawal was accepted and proceedings were terminated. Earlier orders were set aside; each participant bears their own costs, and a refund of 12.50 euros of the appeal fee was ordered.

The dispute and the court’s decision

KERESE 15 NARVA KORTERIÜHISTU sought registration of changes to its address, restrictions on board members’ representation rights, financial-year details and articles of association. The registrar required compliant articles: the submitted text was bilingual, and the name in it differed from the registered name and lacked the full apartment-association designation. A bilingual text was submitted again within the deadline, and Harju Maakohus refused registration. The association appealed, relying on adoption by the general meeting, the primacy of the Estonian text, earlier registrations of similar documents and a registry secretary’s favourable opinion. Tallinna Ringkonnakohus upheld the refusal. In this case, it explained that the register was maintained in Estonian and documents had to be submitted in Estonian or with a proper official translation; submitting one document in two languages did not meet those requirements. Possible earlier incorrect practice did not oblige the registrar to repeat it. A secretary’s opinion likewise did not bind the assistant judge or judge authorised to decide the application. The association bears the costs of both courts. The order provided for an appeal to Riigikohus within 15 days of receiving a copy. Entry into force has not been reverified.

Outcome of this decision

The association’s appeal was dismissed and Harju Maakohus’s refusal of 27 May 2014 to register the amendments was upheld. The association bears the costs of both instances.
